About the Council - HIPAA Statement


According to the Health Insurance Portability and Accountability Act (HIPAA), a covered entity is defined as a health plan, health care clearinghouse, or health care provider. The Pennsylvania Health Care Cost Containment Council (PHC4) is a Public Health Authority, and as such, is not a Covered Entity nor a Business Associate subject to HIPAA requirements.

Since its inception in 1986, and prior to the passage of HIPAA, as a matter of statute, regulation and policy, PHC4 has been governed by the stringent mandates and authority contained in PHC4's enabling legislation, Act 89 of 1986 (as reauthorized by Act 3 of 2009), as well as in regulation, policy and data use agreements, that ensure the confidentiality and privacy of individual patient information.
